Last updated: November 15, 2020

Qudio.com is owned and operated by Cinematiq, LLC, a California limited liability company doing business as “Qudio” ("us", "we", or "our"). This Privacy Policy, together with our Terms and Conditions, sets out the basis on which any Personal Information we collect from you, or that you provide to us, will be used, processed and stored. Please read the following carefully to understand our views and practices regarding your Personal Information and how we will treat it.

By visiting the Qudio.com website you are accepting and consenting to the practices described in this Privacy Policy. If you disagree with any part of this Privacy Policy then you do not have permission to access our website.

DEFINITIONS

"Personal Information" refers to any information that you voluntarily submit to us and that identifies you personally, such as your name, contact information, e-mail address, address, phone number, signature, credit or debit card information, services purchased, geolocation data, and other information about yourself or your business. Personal Information can also include information about any transactions that you enter into on the website.

"Navigational Information" refers to information about your computer and your visits to this website such as your geographical location, browser type, referral source, length of visit and pages viewed.

"Non-Personal Data" is any information that does not relate to a person and/or cannot be used to identify a person. When you interact with our website or services, we may collect Non-Personal Data. The limitations and requirements in this Privacy Policy on our collection, use, disclosure, transfer and storage/retention of Personal Information do not apply to Non-Personal Data. Once Personal Information is in an aggregated form, for purposes of this Privacy Policy, it becomes Non-Personal Data as aggregated information is not linked to any Personal Information that can identify any individual person.

COLLECTION & STORAGE OF INFORMATION

We collect Personal Information from you when you visit our website, order services, or when you contact us. We collect Navigational Information on all users of our website for the purposes described below.

Your Personal Information will be stored on Amazon Web Services (AWS), in a database managed by us, for the uses described in this Privacy Policy. Our website is hosted on AWS.

RETENTION OF PERSONAL INFORMATION

We retain Personal Information that you provide us as long as we consider it potentially useful in contacting you about our services, which means we will retain your Personal Information for an indefinite period of time. We will delete your Personal Information from our database if you so request, as described in "Your Rights With Respect to Your Information" below.

USE OF INFORMATION

Any Personal Information we collect from you may be used in one of the following ways:

We use Navigational Information to operate and improve the website and our service. We may also use Navigational Information alone or in combination with Personal Information to provide you with personalized information about our services.

We may share data with trusted partners to contact you based on your request to receive such communications, help us perform statistical analysis, or provide customer support. Such third parties are prohibited from using your Personal Information except for these purposes, and they are required to maintain the confidentiality of your information.

USE OF INFORMATION BY EVENT ORGANIZERS

Your Personal Information may also be used by event organizers. We have no control over how event organizers store, use or manage your Personal Information.

Organizers can set up event registration pages to collect information from consumers in connection with registration for an organizer's event listed on our website. We do not control an organizer's registration process nor the Personal Information that they collect. When you register for, or otherwise provide information to us in conjunction with an organizer’s event or activity, whether that information is yours or a third party’s, in connection with a purchase, registration, or transfer, that event organizer will receive and may use the information you provide.

We allow Organizers to use our email tools to contact consumers for their current and past events, so you may receive emails from our system that originate with such organizers and that we send on their behalf. If you registered for an event on our website, your email address is available to that organizer. However, organizers may also import the email addresses they have from external sources and send communications through our system to those email addresses, and we will deliver those communications to those email addresses on the organizer's behalf. The organizer and not us is responsible for sending these emails.

Any questions that you may have relating to your Personal Information and your rights under the law should be directed to the event organizer, not to us.

ORDERS & CREDIT CARD INFORMATION

When you purchase services or products from our website, we request information from you on our order form. To place an order, you must provide contact information (like name and address) and financial information (like credit card number and expiration date). This information is used for billing purposes and to fulfill your orders. If we have trouble processing an order, we will use this information to contact you.

If you give us credit or debit card information, we use it to check your financial qualifications and collect payment from you. We use a third-party service provider to manage credit or debit card processing. This service provider is not permitted to store, retain, or use information you provide except for the sole purpose of credit or debit card processing on our behalf. The service provider is responsible for encrypting your information using Secure Socket Layer (SSL) protocol.

Our current payment processing provider is Stripe.com. In order to complete a purchase through our website, you needed to finish the transaction through Stripe. If you checked the box to have your payment information saved by Stripe, but would like that information to be deleted, you need to contact Stripe directly at support@stripe.com.

Marketing

We may use your Personal Information for our marketing and advertising purposes, including (without limitation) by email, SMS marketing, display media, and targeting other devices (such as tablets, mobile devices and televisions). We do this in order to inform you about services or events we believe might be of interest to you, develop promotional or marketing materials and display Qudio or event-related content and advertising on or off our website that we believe might be of interest to you.

We may also use your Personal Information for our marketing and advertising purposes on behalf of an event organizer, for example where your prior interactions with an organizer suggest you may be interested in a particular type of event. We sometimes make inferences about the type of events you may be interested in. We may use these inferences to help target advertising or customize recommendations to you, including on behalf of event organizers. We may do this on an aggregated or generalized basis.

We will be advertising on social media. If you are a member of a social media platform, you might see our advertisements based on the information the social media platform has collected about you, your age, interests, hobbies and other demographic information. We will use the Personal Information we gather on an aggregate basis about our past users, to craft a marketing campaign on a social media platform. Those social media platforms may provide a way to opt out of this type of advertising; please review that platform’s support pages to learn more about managing your account with them and your privacy and marketing choices.

Use of Cookies

We do use "cookies" on this website. A cookie is a piece of data stored on your computer’s hard drive to help us improve your access to our website and identify repeat visitors. Cookies enable us to track and target the interests of our users to enhance their experience on our website. Usage of a cookie is in no way linked to any personally identifiable information on our website.

We keep track of the website and pages you visit, in order to determine what portion of the website or service is the most popular or most used. This data is used to deliver customized content and promotions within the website to customers whose behavior indicates that they are interested in a particular subject area.

You have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. However, if you choose to decline cookies, you may not be able to fully experience the interactive features of the website or the services.

The use of cookies and web beacons by any tracking utility company is not covered by this Privacy Policy. We do not have access or control over these third party tracking technologies, for example, Google Analytics, which is covered later in this Privacy Policy.

Do Not Track Signals

If you have a Do Not Track (DNT) browser mechanism in place, we will honor it. However, if you log-in to our website, or are using our service, we are unable to honor your DNT request as we need to verify your identity. However, guest users with DNT browsers will not be tracked nor will we place cookies on their hard drives. We are relying on a software program developed by a third party to honor your DNT requests.

Google Analytics

We use a tool called “Google Analytics” to collect information about use of this website. Google Analytics collects information such as how often users visit this website, what pages they visit, what time of day they visit the website, and what other sites they used prior to coming to this website. We use the information we get from Google Analytics to improve this website and to provide statistical data to event organizers. Google Analytics collects only the IP address assigned to you on the date you visit this website, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with your Personal Information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this website, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to this website is restricted by Google Analytics’s own terms of use and privacy policy.

Security of Your Personal Information

We use a variety of security technologies and procedures to help protect your Personal Information from unauthorized access, use or disclosure. We secure the Personal Information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure.

Disclosure of Information to Outside Parties

We do not sell your Personal Information to third parties. We may share your Personal Information with trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep your Personal Information confidential. The types of outside parties that we would share your Personal Information include but is not limited to the following: event organizers, Amazon Web Services, Stripe (credit card processing company), Vimeo (video access), RumbleTalk (chat feature), and Google Analytics.

We may also release your Personal Information when we believe release is appropriate to comply with the law, enforce our website policies, or protect ours or others rights, property, or safety.

We may share aggregated demographic information with outside parties such as event organizers, affiliates, partners or advertisers.

Third Party Links

Occasionally, at our discretion, we may provide links to third party products or services on our website. We do not control, and are not responsible for, the content or practices of these third party websites. These third party websites have their own separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked websites. Nonetheless, we seek to protect the integrity of our website and welcome any feedback about these third party websites.

Social Media Features

Our website may include social media features, such as the Facebook Like button or interactive mini-programs that run on our website. These features may collect your IP address, which page you are visiting on our website, and may set a cookie to enable the feature to function properly. Any such social media features are either hosted by a third party or hosted directly on our website. This Privacy Policy does not apply to these features. Your interactions with these features are governed by the privacy policy and other policies of the companies providing them.

International Transfer of Information

To facilitate our global operations, we may transfer and access Personal Information from around the world. This Privacy Policy shall apply even if we transfer Personal Information to other countries.

Your Rights With Respect to Your Information

To exercise any of these rights, please contact us at info@qudio.com. Please note that we may ask you to verify your identity before responding to such requests. We will promptly change, correct, or delete your information and confirm the action we have taken.

However, please note that you cannot opt out of receiving transactional emails related to any service or product you have ordered from our website. Nor may you opt out of general emails from us, of a non-marketing nature (such as notifications of updates to our Terms and Conditions, or this Privacy Policy); to opt out of such general emails from us, you must delete your account.

If you are a resident of the European Economic Area (EEA), you have certain data protection rights under the General Data Protection Regulation (GDPR). You have the right to complain to a Data Protection Authority about our collection and use of your Personal Information. For more information, please contact your local data protection authority in the EEA. A list of Supervisory Authorities is available here: https://edpb.europa.eu/about-edpb/board/members_en.

Children’s Privacy

Protecting the safety of children when they use the Internet is important to us. We do not specifically market to children under the age of 13; our website, products and services are all directed to people who are at least 13 years old or older. We do not knowingly collect any information from anyone under 13 years of age. By using our website and services, you confirm to us that you meet this requirement and that, if you are under the age of 18, you have received permission from your parent or guardian before using the Services or sending any personal information to us or anyone else online. We comply with the requirements of California’s Children Online Privacy Protection Act (COPPA).

Changes to Privacy Policy

Because our website is an evolving medium, we may need to change our Privacy Policy at some point in the future, in which case we will post the updated Privacy Policy on this website and update the Effective Date of the policy to reflect the date of the changes. You should periodically check this page to review the then-current Privacy Policy. Your continued use of this website after any change in this Privacy Policy will constitute your acceptance of such change.

If we make any material change to the Privacy Policy, we will notify you by sending out an email notice that the Privacy Policy has been updated, if we have your email address. Your continued use of the website and/or continued provision of Personal Information to us will be subject to the terms of the then-current Privacy Policy.

Supplemental Privacy Notice for California Residents

If you are a California resident, you may have certain rights under the California Consumer Privacy Act (“CCPA”), or other laws.

Throughout this Privacy Policy, we describe the specific pieces of Personal Information we collect, and how we manage and share it. Under the CCPA, we also have to provide you with the "categories" of personal information we collect and disclose for “business purposes” (as those terms are defined by applicable law). Those categories are identifiers (such as name, address, and email address); commercial information (such as transaction data); financial data (such as credit card and other financial account information); internet or other network or device activity (such as IP address); geolocation information (general location); inference data about you; physical characteristics or description (such as when you voluntarily submit a photo); and other information that identifies or can be reasonably associated with you.

California law may permit you to request that we:

You may have the right to receive information about the financial incentives that we offer (if any). You also have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights. Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide services to you. If you ask us to delete it, you may no longer be able to access or use our service.

The CCPA sets forth certain obligations for businesses that “sell” Personal Information. Based on the definition of “sell” under the CCPA and under current regulatory guidance, we do not believe we engage in such activity. We do share certain information as explained elsewhere in this Privacy Policy.

Supplemental Privacy Notice for Nevada Residents

Under Nevada law, certain Nevada consumers may opt out of the sale of “personally identifiable information” by a person for monetary consideration to license or sell such information to other persons. “Personally identifiable information” includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online. We do not engage in such activity; however, if you are a Nevada resident, you may submit a request to opt out of any potential future sales by emailing us at info@qudio.com. Please note we will take reasonable steps to verify your identity and the authenticity of the request.
